1. Definitions.
"NCIA" is the online service operated by NCIA, Inc. on the World Wide Web, consisting of information services and content provided by NCIA, affiliates of NCIA, and other third parties. "User" means each person who establishes or accesses a connection for access to and use of NCIA.
2. General.
a. This Agreement, which incorporates by reference other provisions applicable to use of NCIA, governs the use of the service. By using NCIA, User agrees to comply with all the terms and conditions set forth herein.
b. NCIA reserves the right at any time to change or discontinue any aspect or feature of NCIA, including but not limited to content, hours of availability, and equipment needed for access or use.
3. Changed Terms.
NCIA may modify or add to these terms and conditions at any time. Any such changes will be effective immediately upon notice, which may be given through various means, including posting on the site or by email. Continued use of NCIA following notice of such changes shall constitute acceptance by the User of those changes.
4. User Conduct.
a. User shall use NCIA for lawful purposes only. User shall not post or transmit any material that is unlawful, threatening, abusive, defamatory, obscene, or otherwise objectionable. Unlawful commercial solicitation or advertising without NCIA's prior consent is prohibited.
b. All content on NCIA, including text, graphics, software, and multimedia, is protected by copyright. Users may download content for personal use only and must not reproduce, distribute, or exploit it for commercial purposes without prior written permission.
5. Disclaimer of Warranty; Limitation of Liability.
a. User agrees that use of NCIA is at the User's sole risk. NCIA does not guarantee uninterrupted or error-free service or accuracy of content.
b. NCIA is provided "as is" without warranties of any kind, either express or implied, except as required by law.
c. NCIA is not responsible for damages resulting from interruptions, errors, viruses, or unauthorized access to user data.
d. In no event shall NCIA be liable for any direct, indirect, incidental, or consequential damages arising from use of the service.
e. NCIA is not liable for content errors, omissions, or delays, or for any third-party claims related to such content.
6. Monitoring.
NCIA reserves the right, but is not obligated, to monitor content on the platform. NCIA may remove or refuse to post content it deems inappropriate or in violation of these Terms.
7. Indemnification.
User agrees to defend, indemnify, and hold NCIA, its affiliates, and their employees harmless from any claims, liabilities, or expenses arising from User's use of the service or violation of these Terms.
8. Termination.
Either party may terminate this Agreement at any time. NCIA reserves the right to suspend or terminate a User’s account for conduct that violates these Terms or is deemed inappropriate by NCIA.
9. Trademarks.
NCIA is a registered trademark of NCIA, Inc. All other trademarks on the platform are property of their respective owners.
10. Third Party Content.
NCIA serves as a distributor of content from third parties. Opinions and information expressed by third-party contributors are their own and do not reflect the views of NCIA. NCIA is not responsible for the accuracy or reliability of such content.
11. Miscellaneous.
This Agreement constitutes the entire agreement between User and NCIA and supersedes all prior agreements. It is governed by the laws of the Philippines. Section titles are for convenience only and have no legal effect.
